- Section 24 of the 2001 Act defines an "instrument" as any document, formal or informal, so a licence card is covered.
- Using a false instrument carries a ceiling of 10 years (section 26). Having one without lawful authority or excuse carries a ceiling of 5 years (section 29(2)).
- All three reported cases below began with a garda stop or investigation, not with a bank or an employer.
- Reported outcomes: a €500 fine, two €750 fines with a destruction order, and a two-year driving ban with €500 in fines.
What counts as fake
The 2001 Act does not use the word "fake". It speaks of a false instrument, and section 30 says an instrument is false if it purports to have been made by someone who did not make it, or on the authority of someone who did not authorise it, or if it has been altered by someone with no right to alter it. A card produced outside NDLS and passed off as an NDLS licence meets that description. So does a foreign-looking card that no foreign authority issued.
The same reasoning applies to a genuine card that has been altered, and to a copy made of a false card to be accepted as a copy of a genuine one (sections 27 and 28).

These are summaries of press reports, not court records. We have left out defendants' names.

The third defendant later livestreamed his own hearing on TikTok and was found in contempt of court, with a one-month sentence suspended for two years. That is a separate matter from the licences, and the court punished it separately.
What the cases have in common
- The fake was found by gardaí on the road or during another inquiry.
- Two of the three cases involved a driver who was disqualified or uninsured, so the sentences were partly about the driving itself.
- The fines were modest against a ceiling of ten years. What it cost the defendants was the ban, a conviction and the destroyed card.
Why a fake does not pass
Every Irish licence and permit carries a driver number, at box 4d on the plastic card. The RSA says it is unique to you across all your licence records, and you need it to book your driving test. NDLS answers a driver statement request or penalty point query from the record behind that number, and only to the email or postal address already linked to it. A forged card has no record behind it, so nothing issued from the record can match it.

How a licence is meant to reach you
NDLS issues a licence after it approves an application, and posts it by An Post standard mail. For a first licence it needs a driving test pass in the last two years. For an exchange it asks you to post in your original foreign licence and can contact the issuing country to check it. A card that came from anywhere else, with none of those steps behind it, is not an NDLS licence.
Frequently asked questions
Is a fake driving licence illegal in Ireland?

What happens if gardaí find a fake licence on you?

Is a foreign fake licence treated differently?

Can a fake licence be exchanged at NDLS?
No. NDLS asks you to post in the original foreign licence, can contact the issuing country to confirm it is valid, and rejects an exchange application where the licence is not submitted.
Does a fake licence make me a licensed driver?
No. Section 38 of the Road Traffic Act 1961 prohibits driving unless you hold a driving licence having effect and licensing you to drive the vehicle.
