Fake driver's licenses and IDs: why they fail and what you risk

Short answer: A fake driver's license is a card made to look like a state license without a state record behind it. Scanner and records checks expose it, and making, selling or using one can fall under federal law, which sets ceilings from 5 to 15 years for common cases.

Two products, one problem

Search results for fake license terms mix three kinds of material: template and prop sites that say the cards are for decoration, sellers advertising cards that scan, and ordinary sample images. The first group still produces a card that copies a government document. The second is selling a counterfeit. The legal question is not what the seller calls it. Federal law looks at what the document is and appears to be, and at what it is used for.

Why a fake does not survive a check

Bars, rental counters, banks and employers see thousands of cards. The checks that matter are not about the artwork:

  • Printed and machine-readable features. Venues commonly use scanners and light checks to compare what the card encodes with what it shows. We did not open a current agency source listing the features, so we do not list them here; each state publishes its own.
  • Records lookup. A check against the issuing state's record finds nothing for a card that was never issued, regardless of how the plastic looks.

Which checks apply depends on who is looking. A bar uses a scanner, police use a records query, a rental counter follows its own procedure. The point for a would-be buyer is simple: the cost of a failed check lands on the person holding the card.

What federal law says

Section 1028 of Title 18 is the main federal statute. Its ceilings, as written in the text we opened:

These are maximums. Courts apply sentencing rules to the facts of each case, and many fake ID cases are charged under state law instead. State offenses for using a false ID, including by minors, differ widely, and we did not review them. For a state-specific answer, check that state's code or speak with a lawyer.

Your identity is the real price

Sellers of fake cards ask for photos of a passport or driver's license, a face photo and a signature, plus an address for shipping. Even if a card arrives, the seller now holds a full set of documents. The FTC's guidance on avoiding scams lists the ways scammers like to be paid, and several are common in this market: cryptocurrency, wire transfers, payment apps and gift cards. Money sent that way is difficult or impossible to recover.

If someone offers you a fake

  1. Do not send a photo of any ID. A seller has no use for it that benefits you.
  2. Do not pay a deposit. Deposits are followed by a second charge “to release the card”.
  3. Report the ad to the platform and the seller's contact details to the FTC and the FBI's IC3 (see where to report).
  4. If you already sent ID photos or money, follow these steps.

If your real reason is that you cannot get a license, the legal paths are more open than sellers suggest. Your state's agency publishes what it requires; the directory links to each one.

The three consequences that are easy to miss

  • Work. A job that requires a license usually involves a verification step. A card with no record behind it ends that process, and sometimes the job.
  • Status. A fake does not make you a licensed driver. If you are stopped, the card is checked against the state's records, not against its appearance.
  • Identity. Photos of a real license sent to a seller can be reused. The recovery steps apply even if a card arrives.

The sentencing ceilings above are not predictions. They show how seriously the statute treats production and transfer, which is where sellers sit. The person who buys is exposed under the other paragraphs and under state law.

Is a fake driver's license illegal?

Making or transferring one that appears to be a driver's license can carry up to 15 years under 18 U.S.C. 1028(b)(1). Other production, transfer or use carries a 5-year ceiling in the same section. Many cases are also charged under state law, which varies. Can a fake ID scan?

Sellers claim so. A scan only reads the encoded data; a records check against the state's database still finds no issued license. Scanning is only one layer. A records check, a trained eye and the context of the request all count, and a failure in any one of them can end the transaction.

What if the site says it is only a novelty ID?

A card made to look like a state license copies a government document whatever label the seller uses. Federal law looks at whether the document appears to be a license and how it is used. That is true even for a product sold as a prop. The label on the seller's page does not change what the card is or how a court may see it.

How can I tell if a driver's license is fake?

Do not rely on looks. For official purposes, confirm through the issuing agency, and check the security features that the state publishes. Employers and rental firms follow their own verification process. If you are a business that must verify IDs, follow your state's guidance and your own written procedure instead of relying on a general rule.

What should I do if I bought a fake ID?

Stop using it, do not buy more, and consider speaking with a lawyer about your exposure. If you sent ID photos or payment, report to the FTC and IC3, and watch your credit for misuse. It is also worth reading the recovery steps, since sellers keep the ID photos you sent and can reuse them.
