Having one without lawful authority or excuse carries a ceiling of 5 years (section 29(2)).<\/li>\n<li>All three reported cases below began with a garda stop or investigation, not with a bank or an employer.<\/li>\n<li>Reported outcomes: a &euro;500 fine, two &euro;750 fines with a destruction order, and a two-year driving ban with &euro;500 in fines.<\/li>\n<\/ul>\n<\/div>\n<h2 id=\"s1\">What counts as fake<\/h2>\n<p>The 2001 Act does not use the word &#8220;fake&#8221;. It speaks of a <em>false instrument<\/em>, and section 30 says an instrument is false if it purports to have been made by someone who did not make it, or on the authority of someone who did not authorise it, or if it has been altered by someone with no right to alter it. A card produced outside NDLS and passed off as an NDLS licence meets that description. So does a foreign-looking card that no foreign authority issued.<\/p>\n<p>The same reasoning applies to a genuine card that has been altered, and to a copy made of a false card to be accepted as a copy of a genuine one (sections 27 and 28).<\/p>\n<h2 id=\"s2\">Three reported cases<\/h2>\n<p>These are summaries of press reports, not court records. He admitted straight away that it was false. Charge: using a false driving licence, section 26 of the 2001 Act.<\/td>\n<td>&euro;500 fine, 12 months to pay<\/td>\n<\/tr>\n<tr>\n<td>Roscommon District Court (offence date 24 December 2024)<\/td>\n<td>A 35-year-old was charged with possession and use of a forged Portuguese driving licence on the Athlone Road. He said it rested on a reciprocal arrangement for Brazilian licences. The judge said the aim was to &#8220;get one over on insurance companies&#8221;.<\/td>\n<td>Two fines of &euro;750 each, and an order to destroy the licence<\/td>\n<\/tr>\n<tr>\n<td>Dublin District Court, 26 September 2024<\/td>\n<td>A man from Liverpool was stopped on Aston Quay on 21 September 2024. He admitted driving without insurance and possessing a fake Irish and a fake British licence.<\/td>\n<td>Two-year driving ban and fines totalling &euro;500<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>The third defendant later livestreamed his own hearing on TikTok and was found in contempt of court, with a one-month sentence suspended for two years. That is a separate matter from the licences, and the court punished it separately.<\/p>\n<h2 id=\"s3\">What the cases have in common<\/h2>\n<ul>\n<li>The fake was found by garda\u00ed on the road or during another inquiry.<\/li>\n<li>Two of the three cases involved a driver who was disqualified or uninsured, so the sentences were partly about the driving itself.<\/li>\n<li>The fines were modest against a ceiling of ten years. What it cost the defendants was the ban, a conviction and the destroyed card.<\/li>\n<\/ul>\n<h2 id=\"s4\">Why a fake does not pass<\/h2>\n<p>Every Irish licence and permit carries a driver number, at box 4d on the plastic card. The RSA says it is unique to you across all your licence records, and you need it to book your driving test. NDLS answers a <a href=\"\/ie\/check-penalty-points-ireland\/\">driver statement request or penalty point query<\/a> from the record behind that number, and only to the email or postal address already linked to it. For a first licence it needs a driving test pass in the last two years. For an exchange it asks you to post in your original foreign licence and can contact the issuing country to check it. A card that came from anywhere else, with none of those steps behind it, is not an NDLS licence.<\/p>\n<h2 id=\"faq\">Frequently asked questions<\/h2>\n<details>\n<summary>Is a fake driving licence illegal in Ireland?<\/summary>\n<p>Yes, in the circumstances the 2001 Act covers.
